By downloading, installing, or using the Optimiz mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
Optimiz is a sleep improvement application that uses your smartphone's sensors to analyze sleep stages and play adaptive soundwaves designed to enhance sleep quality. The App is intended for general wellness purposes only and is not a medical device.
Optimiz is not a medical device and should not be used to diagnose, treat, cure, or prevent any disease or medical condition.
Optimiz does not require an account to use core features. If you create an optional account for cloud backup or premium features, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

The App, including its design, algorithms, sound files, and content, is protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
Some features require a paid subscription. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Manage subscriptions through your device's app store. Refunds are subject to the app store's refund policy.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT SLEEP TRACKING WILL BE COMPLETELY ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIMIZ AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
We may modify these Terms at any time. We will notify users of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the new Terms.
We reserve the right to suspend or terminate your access to the App for violation of these Terms. You may stop using the App at any time by uninstalling it from your device.
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
